The Laws Outside Are Frightful
’Tw̓as the night before Christmas, and all through the country,
The NLRB wasn’t stirring . . . because it’s being sued for (allegedly) being unconstitutional.
Policies lingered from months gone by,
Not a handbook was current, not since July.
SHRM was nestled, all smug in its chairs,
While lawsuits piled on, the “experts” seemingly unaware.
(Yes, they were sued . . . again. Yes, it involves a service dog. No, we’re not making this up.)
When out on the horizon, there arose such a clatter,
Minimum wage and salary thresholds for exempt status . . . did these just get fatter??
(Don’t act surprised – this literally happens every single year.)
And what to my wondering eyes should appear,
A possible federal law on AI regulation may soon be here,
Will this lead to preemption (and interfere with the growing pile of state and local laws already passed, including several that directly implicate fair employment laws, and create utter chaos and uncertainty?) . . . oh dear.
Non-competes lurked too – the government blinked, but enforcement’s not through;
“Selective enforcement” is what the FTC’s planning to do;
But as for the states, think twice before including such a clause,
And if you’re in healthcare? Then you really should pause . . .
. . . unless you’re in Florida, which went feral and doubled down, because of course it did.
And speaking of enforcement, oh look, it’s the EEOC,
Announcing its upcoming agenda with glee;
Religious discrimination, protecting “traditional” workplace values, and anti-DEI – oh my,
If you’re an owner wondering what to do, just swing by.
Salary transparency laws as far as the eye can see,
Requiring the posting of ranges once kept under lock and key;
And if you think your jurisdiction doesn’t apply, or you’ll somehow avoid it,
Allow us to remind you . . . fuhgettaboutit.
And so here we all are, at year’s weary end,
Holiday parties and festive cheer – cash bars are your friend;
Handbooks need updates, managers need training,
Treating people consistently? Remains surprisingly restraining.
